General Terms of Use

Scope

These terms apply to the publicly accessible phifux.com website and, unless the relevant customer agreement provides otherwise, individually provided digital applications by phifux e.U. Individual proposals, specifications and agreements take precedence.

Company Website

The website provides information about phifux and its services. Services cannot be ordered, booked or paid for directly through the website. An agreement is formed only through a separate arrangement or acceptance of a proposal.

Individually Provided Applications

Digital applications are currently configured only for selected business customers. Scope, functionality, fees, term and support are set out in the relevant proposal or customer agreement. Access must not be shared with unauthorised third parties.

API Integrations and External Platforms

API integrations require the customer to be authorised to use the connected account and grant the requested permissions. The customer is responsible for its content, the lawfulness of processing and compliance with the terms of the relevant platform provider.

External platform functions may change, be restricted or discontinued. Where this is outside phifux's control, their continued availability is not guaranteed. Necessary adaptations are agreed separately unless otherwise provided.

Credentials and Security

Credentials and authorisation tokens must be kept confidential. Suspected misuse or loss must be reported to phifux without delay. Protective measures must not be circumvented and applications must not be tested for vulnerabilities unless expressly agreed.

Content and Rights

The customer must ensure that content it uses or processes through an application is lawful and does not infringe third-party rights. Rights in customer-provided content remain with the relevant rights holder. Rights in software, design and original phifux components are governed by the individual agreement.

Availability

Uninterrupted availability is owed only where expressly agreed. Maintenance, security measures, technical disruptions and changes to external services may affect availability.

Privacy

Information about personal data processing is available in the Privacy Policy. Where phifux processes personal data on behalf of a customer, an agreement under Article 28 GDPR will be concluded where required.

Liability

Liability is governed by statutory provisions and the relevant individual agreement. phifux is not responsible for customer content, unauthorised use of customer accounts, or outages and changes to external platforms where these circumstances are not attributable to phifux.

Changes

phifux may adapt these terms with effect for the future where technical, legal or organisational reasons require it. Changes apply to existing agreements only in accordance with the relevant agreement and statutory requirements.

Applicable Law

Austrian law applies, excluding its conflict-of-law rules. For business customers, the courts with subject-matter jurisdiction in Vienna have exclusive jurisdiction to the extent permitted by law.
